Linc Air Charter Services, LLC - Terms and Conditions

1. General Linc Air Charter Services, LLC (“Linc Air”) is a private jet charter broker and
not a direct air carrier. All flights arranged by Linc Air are operated by third-party FAA-
certificated Part 135 air carriers or foreign equivalent carriers (“Operators”) who
maintain full operational control of the aircraft. Linc Air acts solely as an agent for its
clients (“Client”) to arrange charter services and does not operate aircraft. Each flight
arranged by Linc Air is subject to these Terms and Conditions and will be confirmed
through a separate Charter Quote, which outlines specific flight details, aircraft type,
pricing, cancellation terms, and any other applicable terms.
2. Charter Quotes and Pricing The Charter Quote will provide the flight itinerary,
aircraft details, pricing, and associated terms. Pricing includes only those services
specified in the quote. Any additional services requested by Client, such as catering,
ground transportation, de-icing, fuel surcharges, international fees, or other incidentals,
will be billed separately. All applicable federal, state, and local taxes, including FET and
segment fees, will be added to the quote.
3. Payment Full payment is due upon confirmation of each charter. Flights are not
guaranteed until payment is received in full. Payments may be made via wire transfer or
other methods approved by Linc Air. Credit card payments, if accepted, may be subject
to additional processing fees. All payments are non-refundable unless otherwise stated
in the Charter Quote.
4. Cancellations and Changes Cancellations are subject to the Operator’s cancellation
policy as described in the Charter Quote. Depending on timing and nature of the trip,
cancellations may result in a charge up to 100% of the total charter price. Any changes
to the itinerary, aircraft, or passenger count may be treated as a cancellation and
subject to fees. No-shows are considered cancellations.
5. Force Majeure Neither Linc Air nor the Operator shall be liable for any delay,
change, or cancellation of a flight due to causes beyond their control, including but not
limited to weather, mechanical issues, crew availability, governmental restrictions, war,
terrorism, or other force majeure events. In such events, Linc Air will use reasonable
efforts to locate an alternative Operator, but does not guarantee replacement or
reimbursement.
6. Passenger Responsibilities and Identification Client is responsible for providing
accurate passenger information and ensuring all passengers carry valid government-
issued identification for domestic flights and passports/visas for international travel.
Failure to provide required documentation may result in denied boarding. Linc Air bears
no responsibility for such occurrences.
7. Damage and Conduct Client is responsible for any damage to the aircraft caused by
the Client or their guests, including excessive wear, cleaning fees, or violations of
aircraft rules (e.g., smoking or pet transport when not authorized). Additional fees may
be assessed and invoiced to the Client.

8. Regulatory Compliance Client agrees to comply with all FAA, DOT, TSA, and other
applicable regulations. Client may not resell individual seats or engage in activity that
would classify the charter as a scheduled flight. Linc Air reserves the right to refuse
service if Client fails to comply with legal or regulatory obligations.
9. Limitation of Liability and Indemnity Linc Air shall not be liable for any indirect,
incidental, special, consequential, or punitive damages, including lost profits. The total
liability of Linc Air, if any, shall not exceed the charter price paid for the affected flight
segment. Client agrees to indemnify and hold harmless Linc Air, its affiliates, officers,
employees, and agents against any claims arising from breach of these terms,
passenger conduct, or violations of law.
10. Insurance Disclosure Linc Air does not maintain non-owned aircraft liability
insurance. Linc Air will utilize operators having an active insurance certificate available
to cover liability and bodily harm. All flights arranged are operated by carriers who meet
FAA safety standards. Linc Air does not guarantee the financial condition or fitness of
any Operator.
11. Governing Law and Jurisdiction This Agreement shall be governed by and
construed in accordance with the laws of the State of Michigan. Any disputes arising out
of or in connection with this Agreement shall be subject to the exclusive jurisdiction of
the state and federal courts located in Grand Rapids, Michigan. The parties waive any
right to a trial by jury.
12. Notices and Electronic Signature All notices shall be in writing and sent by mail,
courier, or electronic means to the parties’ designated addresses. The Client
acknowledges that electronic signature (including via DocuSign or similar service) shall
constitute execution and acceptance of this Agreement and all Charter Quotes issued
under it.
13. Entire Agreement These Terms and Conditions, together with the applicable
Charter Quote, constitute the entire agreement between Linc Air and the Client. Any
amendments must be in writing and agreed by both parties. If any provision is deemed
unenforceable, the remaining terms shall remain in full force and effect.
